3. ORDERS

3.1 All orders You place for Goods displayed on the Website are subject to availability and it is Your responsibility to ensure that Your order is correct. When You place an order for Goods, this constitutes an offer to purchase those Goods which National Weaving Company may or may not accept.

3.2 National Weaving Company reserves the right to correct typographical errors in any elements of the information that appears on the Website including pricing mistakes. If, once You are informed of such error, You wish to withdraw Your offer and do not wish to proceed with the purchase, You shall be free to do so and any moneys already paid by You will be refunded in full.

3.3 Orders for Goods will only be taken for delivery of Goods to such countries as indicated on the Website.

3.4 Any representations of the Goods shown on the Website are provided for the purposes of guidance only.

3.5 You are responsible for the payment of any local taxes due upon delivery and/or import of Goods to You by National Weaving Company and You indemnify and will keep indemnified National Weaving Company against any claim for such payments and/or taxes.
4. PAYMENT

4.1 You agree to pay the Fee at the time You place Your order.

4.2 Once You have confirmed Your order on the secure payment screen it cannot be cancelled or changed except in accordance with clause 6 of these Terms.

4.3 In the event that Your debit or credit card payment is refused by Your card issuer for whatever reason, National Weaving Company may terminate these terms and conditions without further obligation to you.

4.4 Non-delivery by any third party [including but not limited to the Royal Mail] shall not give You any right to delay payment to National Weaving Company or to make any claim whatsoever against National Weaving Company.
5. RISK AND TITLE

5.1 Risk in the Goods shall pass to You upon payment of the Fee or, if earlier, upon delivery of the same to You. Title to the Goods shall pass to You only upon payment of the fee in cleared funds and You shall hold the Goods as bailee for National Weaving Company until National Weaving Company has received payment in full of all Fees outstanding to it from You.

5.2 If any of the Goods are destroyed, damaged or lost from any cause [other than the fault or negligence of National Weaving Company], National Weaving Company may replace those Goods but shall be entitled to charge you for the replacement of them.
6. CANCELLATION OF ORDERS AND RETURNS

6.1 National Weaving Company may refuse cancellation of any orders for personalized Goods once the Order has been placed. If You make a mistake in your order National Weaving Company will offer to re-issue the Goods at full price plus any applicable delivery charges. Please note that Personalized Goods are exempt from the Consumer Protection (Distance Selling) Regulations 2000.

6.2 If You notice an error in Your Order, it is advised to report it to National Weaving immediately by phone on 01834 861446 or by email to sales@nationalweaving.co.uk. National Weaving Company will correct any mistakes at the customer’s request where the request has been received before commencement of producing personalized products. A request to amend an order will be considered received when an employee of National Weaving Company has confirmed receipt to You on the telephone, or by email. Any amendments requested outside of working hours cannot be guaranteed to be in receipt of National Weaving Company before production of Your Order. It is therefore recommended to phone National Weaving Company rather than email to get an immediate response relating to Your Order.

6.3 Any errors caused by negligence of National Weaving Company must be reported to us within 30 days of receipt of the order. National Weaving Company will resolve based on the terms set out in clause 6.5.

6.4 If You do not receive an order or part thereof within 7 Working Days of the Delivery estimate, You must contact National Weaving Company within 30 days of the projected delivery date. If National Weaving Company does not receive notification within 30 days of the projected received date of an undelivered Order, National Weaving Company will not be liable to re-issue, replace or refund the Order. Once notification is received that an order has not been received by You, National Weaving Company may investigate the cause of non-delivery with any applicable delivery companies [e.g. Royal Mail] and follow through any claims procedures with these companies before re-issuing the Goods or providing a refund. National Weaving Company will not be liable to re-issue any Goods which have been with a delivery company for less than 15 Working Days for delivery to a UK address or 30 Working Days for Deliveries outside the UK. Any personalized Goods which are re-issued will be subject to the same production times as originally stated.

6.5 If You wish to cancel a purchase You must notify National Weaving Company by telephoning 01834 861446 or emailing sales@nationalweaving.co.uk . National Weaving Company reserves the right to refuse cancellation of any order that has entered production. If You have received the Goods and wish to return them, National Weaving Company will only accept returns on faulty Goods, or Goods which have been made incorrectly because of negligence caused by National Weaving Company. You must return them to National Weaving Company by recorded mail, enclosing a covering letter, to CUSTOMER RETURNS DEPARTMENT, National Weaving Company, Redstone Mill, Redstone road, Narberth, Pembrokeshire, SA67 7ES. You are responsible for the Goods whilst they are in transit until they are actively received by National Weaving Company.

6.6 Upon cancellation of an order National Weaving Company will refund the whole sum paid by You [including costs of postage and packing for delivery to You] within 30 days of National Weaving Company notifying You of acceptance of Your cancellation request. National Weaving Company currently do not offer an exchange service on personalized goods unless faulty. If You wish to exchange an item, please return the Goods as above and National Weaving Company shall contact You and assist You with Your new order. National Weaving Company will refund, where appropriate, and delivery costs for returning faulty items to National Weaving Company.

6.7 If any of the Goods You receive are defective or do not match the order placed, You may return them to National Weaving Company by recorded mail enclosing a covering letter stating the nature of defect or mistake and if it is satisfied that the Goods are defective or do not match the order You placed, National Weaving Company will replace such Goods or refund of the Fee [and the cost of returning those Goods.]

6.8 National Weaving Company’s sole liability to the Client for Goods which are defective or which do not match the Client's order shall be limited to replacement of those Goods or refund of the Fee and delivery charges.

6.9 Once an order is placed by You via phone, post, fax or on the website www.nationalweaving.com, National Weaving Company is unable to guarantee it is possible to change or cancel that order. National Weaving Company are unable to make any changes or cancellations to ANY orders posted to us. National Weaving Company will not issue any credits or remakes under any circumstances for any errors the customer makes on an order.
7. WARRANTY AND LIMITATION OF LIABILITY

7.1 National Weaving Company warrants that Goods purchased through the Website will be of satisfactory quality and fit for the purpose for which they are designed.

7.2 National Weaving Company shall not be liable to any person for any loss or damage arising from the use of any Goods or information displayed on the Website.

7.3 National Weaving Company shall not in any event be liable (whether in contract or otherwise) for any indirect loss, consequential loss, loss of profit, revenue, data or goodwill howsoever arising suffered by You or for any wasted management time, failure to make anticipated savings or liability You may incur to any third party arising in any way in connection with these Terms or otherwise whether or not such loss has been discussed by National Weaving Company and You pre-contract or for any account for profit, costs or expenses arising from such damage or loss.

7.4 National Weaving Company’s aggregate liability in respect of these Terms and any matter arising out of it [including claims whether made in contract or tort] shall be limited to a sum equal to the Fee including VAT where applicable.

7.5 National Weaving Company shall not be liable for any loss or damage of any nature caused by or arising from errors in or material omissions from the Goods.

7.6 Subject as expressly provided in these Terms all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

7.7 Nothing in this clause shall operate so as to exclude National Weaving Company’s liability for death or personal injury arising out of its negligence.

7.8 Each foregoing sub-clause of this clause shall constitute a separate and severable provision. The provisions of this clause shall continue in effect notwithstanding the termination, completion or any other matter which might otherwise cause these Terms to become ineffective.
8. MISCELLANEOUS

8.1 These Terms shall form the entire agreement between the parties and supersede any previous agreement and [save so far as expressly preserved hereby] representations oral or otherwise made by either of the parties. You warrant that You have not relied on any representation made by National Weaving Company in entering into this agreement.

8.2 Failure by either party at any time to enforce any right claim or provision of these Terms or arising hereunder shall not be construed as a waiver of such right, claim or provision.

8.3 All notices to National Weaving Company shall be given by You in writing to the address shown above. All notices to You shall be given in writing to Your email address or to the address You have given for delivery of Goods. All notices may be served by personal delivery or first class post. Any notice given by post shall be deemed to be received by the party to whom it was given 48 hours after posting [excluding Saturday, Sundays and UK bank and public holidays]. Notices given by email shall be deemed to have been given 1 hour after transmission thereof.

8.4 These Terms and Your agreement with National Weaving Company shall be governed and construed in accordance with English Law. You irrevocably agree for the exclusive benefit of National Weaving Company to submit any dispute hereunder to the jurisdiction of the courts of England & Wales but nothing herein shall prevent National Weaving Company from taking proceedings against You in any other court of competent jurisdiction.
